Entries from 18/07/13 and closes 23:59pm 18/08/13 inclusive (the “Entry Period”). No entries will be accepted outside the Entry Period.
Prize is valued at $502 NZD. Prize is not transferable or redeemable for cash and must be redeemed by 21 December 2013. The winner will need to pre-book the prize experience directly with The Esplanade Hotel. Winner will be contacted by e-mail and their
name will be published on the Visit Devonport Facebookpage and Twitter.
The Promoter will select the winners by random draw from all eligible entries submitted during the Entry Period. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion.
The Promoter takes no responsibility for lost, damaged, misdirected, late, illegible or incomplete entries. By entering this competition the entrant agrees that the Promoter may collect and hold their personal information for the purposes of notifying the winner and to verify the eligibility and identity of the winners. The Promoter in the Promoter’s sole discretion reserves the right to cancel, terminate, modify or suspend this competition at any time and for any reason.

Prize Draw and Winner Selection
Competition prize is valued at $502.00 NZD. Any travel and expenses associated with the prize are to be borne by the winner. Prize is not redeemable for cash. The winner will need to pre-book the prize directly with The Esplanade Hotel as rooms are subject to availability.
The gift voucher prize will be posted to a physical address. The winner must provide proof of identification when redeeming the prize. The competition will be drawn on 20/08/2013 at Visit Devonport.
By accepting the Prize the winner agrees that the winner’s name and photograph may be used for publicity purposes. The winner also agrees to participate in any publicity activities that the Promoter may reasonably require. The winner is not entitled to any payment or other compensation in connection with these activities. To the extent permitted by law, the Promoter and its employees and agents will not be liable for any claims, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with this competition and/or the Prize. The Promoter’s decision regarding the winner is final and binding – no correspondence will be entered into.
If a winner cannot be contacted within a 24 hour notice period or is unable to accept his/her status as winner for any reason, his/her selection as winner will be forfeited and an alternative winner may be selected provided sufficient time remains, in the Promoter’s sole discretion.
Liability
All entrants release and indemnify the Promoter from any and all direct or indirect loss or injury suffered by the Promoter and arising in connection with the Promotion or the Prize.
Participants must comply with all requirements of the Promoter including requirements specified in the Terms and Conditions. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:
- fails to establish their entitlement to enter the Promotion to the Promoter’s satisfaction;
- tampers with or benefits from any tampering with the entry process or the operation of the Promotion;
- submits an entry which in the Promoter’s opinion is not in accordance with these Terms and Conditions;
- acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person; or
- in the opinion of Promoter, engages in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.
If for any reason any aspect of the Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries.
Except for any liability that cannot be excluded by law, including but not limited to the New Zealand Consumer Guarantees Act 1993, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) use of a prize.

The Promoter may at any time, modify or alter the Promotion or any aspect of the Promotion without prior notice. Notification of such modifications will be posted on the Visit Devonport NZ Facebook Page.
